2. Who We Are

FundUp is an Australian mortgage brokerage that specialises in home loans, investment loans, refinancing, and asset finance for self-employed borrowers and small business owners.

We operate as a Credit Representative under the Australian Credit Licence held by LMG Broker Services Pty Ltd. In providing credit assistance, we are subject to the National Consumer Credit Protection Act 2009 (Cth) (NCCP Act) and the responsible lending obligations it imposes.

3. What Personal Information We Collect

3.1 Information you give us directly

We collect personal information you provide when you:

  • book or attend a free consultation
  • apply for a home loan, investment loan, refinance, or asset finance product

As part of assessing your loan application, we may collect, use, and disclose credit information as defined under the Privacy Act. This includes: credit liability information (existing debts, repayment history); repayment history information obtained from credit reporting bodies (CRBs); information about credit applications you have made; court judgments, insolvency information, and serious credit infringements (if applicable).

We handle credit information in accordance with the Privacy (Credit Reporting) Code 2014 and the requirements of the NCCP Act.

3.3 Information collected automatically

When you visit our website, we may collect technical information including: IP address and browser type; pages visited and time spent on the site; referral source (e.g., how you found our website); cookie identifiers and similar tracking technologies.

We use this data to improve website performance and to measure the effectiveness of our advertising. See Section 8 for more detail on cookies and digital tracking.

4. Why We Collect Your Information

We collect personal information for the following purposes:

5. How We Disclose Your Information

5.1 Lenders and product providers

To provide credit assistance, we will share your personal information with lenders on our panel. These include banks, non-bank lenders, and specialist lenders. The specific lenders we approach on your behalf will be disclosed to you during the application process.

5.2 Our aggregator

We operate under LMG Broker Services Pty Ltd as our aggregator. LMG may access information relating to your application for compliance, auditing, and quality assurance purposes. LMG's privacy policy is available at lmgbrokerservices.com.au.

5.3 Service providers

We use third-party service providers to operate our business. These providers may access your personal information only to the extent necessary to perform their services. They include: CRM and practice management software providers (including GoHighLevel); cloud storage and document management providers; email and communication platform providers; advertising and analytics platforms (see Section 8); identity verification services.

We take reasonable steps to ensure service providers handle your information in accordance with this policy and applicable privacy laws.

We may disclose your personal information to credit reporting bodies (CRBs) as part of assessing your credit application. CRBs are required to handle your information in accordance with the Privacy Act and the Privacy (Credit Reporting) Code.

The CRBs we may use include Equifax, Experian, and illion. Each CRB has its own privacy policy and procedures for managing credit-related information.

5.5 Legal and regulatory requirements

We may disclose your personal information to government bodies, regulators, or law enforcement agencies where required or authorised by law, including: Australian Securities and Investments Commission (ASIC); Australian Financial Complaints Authority (AFCA); Australian Transaction Reports and Analysis Centre (AUSTRAC); other regulatory bodies with relevant jurisdiction.

5.6 Overseas disclosure

Some of our service providers may store or process data outside Australia. Where this occurs, we take reasonable steps to ensure those providers are subject to privacy obligations comparable to the APPs. By using our services, you consent to your information being handled by overseas recipients where this is necessary for the provision of our services.

We will not otherwise disclose your personal information to overseas recipients without your consent, unless permitted by law.

We store your personal information on secure systems, including cloud-based CRM and document management platforms. We take reasonable technical and organisational steps to protect your information from misuse, interference, loss, and unauthorised access, modification, or disclosure.

These measures include: encryption of data in transit and at rest; access controls and password protection; staff training on privacy and data security obligations; regular review of our data handling practices.

We retain your personal information for as long as is necessary to fulfil the purposes for which it was collected, or as required by law. Loan application records are generally retained for a minimum of 7 years in accordance with NCCP Act obligations.

We may use your contact details to send you information about our products and services, market updates, and content relevant to self-employed borrowers where: you have consented to receive such communications, or we reasonably believe the communication is directly related to your use of our services.

You can opt out of marketing communications at any time by: clicking the unsubscribe link in any email we send; or contacting us directly using the details in Section 11.

We will not use sensitive information (as defined by the Privacy Act) for direct marketing purposes without your explicit consent.

8. Cookies, Pixels, and Digital Tracking

8.1 What we use

Our website uses cookies, pixels, and similar tracking technologies for the following purposes: measuring website traffic and user behaviour (e.g., Google Analytics); tracking conversions and advertising performance; delivering and optimising paid advertising on Meta (Facebook and Instagram) and Google.

8.2 Meta Pixel

We use the Meta Pixel (ID: 927553086670437) on our website. The Meta Pixel collects information about your actions on our website (such as pages visited and forms submitted) and may share that information with Meta Platforms, Inc. This allows us to measure the effectiveness of our advertising and show relevant ads to people who have visited our website.
